Terms of Service

Welcome to Opengraphy AI ("we," "our," or "us"). By accessing or using our website, software, and AI-powered services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

Our Service integrates third-party AI models (including Google Gemini, RunwayML, and ElevenLabs) to generate text, images, video, and audio. By using the Service, you acknowledge:

• Unpredictability: AI outputs are probabilistic and may be inaccurate, offensive, or nonsensical ("hallucinations"). We do not guarantee the accuracy or reliability of generated content.
• No Manual Control: We do not manually review all generated content. You are solely responsible for reviewing and verifying any output before use.
• Non-Exclusivity: Due to the nature of AI, identical or similar outputs may be generated for other users. You may not claim exclusive rights to generic AI-generated patterns.

To ensure service stability and availability for all users, we enforce a strict Fair Usage Policy.

• High-Cost Resources: Video (RunwayML) and Audio (ElevenLabs) generation are computationally expensive. Excessive use beyond typical human operation patterns may result in throttling or temporary suspension.
• API Limits: We reserve the right to impose limits on the number of requests you can make within a specific timeframe.
• Abuse: Automated scraping, reverse engineering, or attempting to bypass our rate limits is strictly prohibited and will result in immediate account termination.

Your Input: You retain all rights to the text, images, and data you upload to the Service ("Input").

AI Output: Subject to your compliance with these Terms and payment of applicable fees, Opengraphy assigns to you all its right, title, and interest in the content generated by the Service based on your Input ("Output").

Platform Rights: Opengraphy retains all rights to the underlying software, algorithms, interface designs, and pre-existing templates used to provide the Service.

You agree NOT to use the Service to:

• Generate content that is illegal, defamatory, pornographic, hateful, or promotes violence.
• Infringe upon the intellectual property or privacy rights of others.
• Generate "deepfakes" or misleading content intended to deceive regarding public figures or events.
• Represent AI-generated content as human-generated where prohibited by law.

You are responsible for ensuring your use of the Service complies with all applicable laws in your jurisdiction (including Belgium and your country of residence).

Fees: Access to certain features requires a subscription or one-time payment. All fees are non-refundable except as required by law.

Cancellations: You may cancel your subscription at any time. Access will continue until the end of the current billing period.

Changes: We reserve the right to change our pricing with reasonable notice. Continued use after a price change constitutes acceptance.

To the maximum extent permitted by law, Opengraphy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

Our total liability for any claim arising out of these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

These Terms are governed by the laws of Belgium. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium.
